Stage 1 – Allocation of mediator
The parties agree to mediate and we will allocate a mediator.
Stage 2 – Preliminary contact with Party 1
The mediator will make an initial contact with Party 1 – to understand the situation and key issues.
Stage 3 –Preliminary contact with Party 2
The mediator will make an initial contact with Party 2 – to understand the situation and key issues.
Stage 4 – Preparation for the mediation
The mediator will arrange the date and time with both parties and agree the most effective and efficient way to deal with the dispute. At this stage, the parties will receive a ‘Mediation Agreement’ and the ‘Ground Rules’ for mediation.
Stage 5 – The online/telephone mediation process
The mediation process with both parties present. Both parties will have an opportunity to put forward their case and go through their issues. The mediator will look to explore and work on the issues that are raised.
Stage 6 – Drafting the agreement
Building an agreement based on the discussions. The agreement will be drafted and can either be a formal legally binding document or an informal document.
